§1

Definitions

  1. "Controller" means the natural or legal person, public authority, entity or other body which alone or jointly with others determines the purposes and means of the processing of personal data; where the purposes and means of such processing are determined by Union law or Member State law, a controller may also be designated by Union law or Member State law, or specific criteria for its designation may be laid down.
  2. "Personal data" means any information about an identified or identifiable natural person ("data subject"); an identifiable natural person is one who can be identified, directly or indirectly, in particular by reference to an identifier such as a name, an identification number, location data, an online identifier or to one or more factors specific to the physical, physiological, genetic, mental, economic, cultural or social identity of the natural person.
  3. "Processing" means an operation or set of operations which is performed upon personal data or sets of personal data, whether or not by automated means, such as collection, recording, organisation, organisation, storage, adaptation or alteration, retrieval, consultation, use, disclosure by transmission, dissemination or otherwise making available, alignment or combination, restriction, erasure or destruction.
  4. "Data recipient" means a natural or legal person, public authority, entity or other body to whom personal data is disclosed, whether or not a third party.
  5. "Consent of the data subject" means a freely given, specific, informed and unambiguous demonstration of will by which the data subject, by means of a statement or a clear affirmative action, consents to the processing of personal data concerning him or her.
  6. "Cookies" - means IT data, in particular small text files, recorded and stored on the devices through which the User accesses the Website.
  7. "Website" - means the website under which the Administrator operates the website, operating in the domain altkomakademia.pl.
  8. "Device" - means the electronic device through which the User accesses the websites of the Website.
  9. "User" - means an entity to whom, in accordance with the Terms and Conditions and the law, electronic services may be provided or with whom an Agreement for the provision of electronic services may be concluded.
  10. "GDPR" - Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data and repealing Directive 95/46/EC (General Data Protection Regulation).

§3

Purpose and legal basis for processing personal data

Your personal data will be processed for:

  1. the delivery of the training delivery service - pursuant to Article 6(1)(b) of the GDPR,
  2. Marketing of products and services - the basis for processing is Article 6(1)(a) "consent" of the GDPR,
  3. to respond to an enquiry made using the contact form on the basis of Article 6(1)(b) of the GDPR,
  4. the handling of complaints, claims and requests and, as part of this, to provide a response on the basis of Article 6(1)(b) of the GDPR,
  5. the possible establishment, investigation, enforcement or defence of claims, which are the fulfilment of the Administrator's legitimate interest (such as debt collection, conducting court and enforcement proceedings) on the basis of Article 6(1)(c) and (f) of the GDPR,
  6. prevention of fraud and abuse - in order to ensure the security of the Services provided in accordance with Article 6(1)(f) of the GDPR,
  7. to remember your preferences and settings such as login, password, IP address, date and time of login - in which case the basis for processing will be Article 6(1)(f) GDPR in conjunction with Article 173, Telecommunications Law.

§4

Scope of personal data collected

  1. In the process of registration and further use of altkomakademia.pl, we ask for your personal data in order to carry out the services provided via our website.
  2. In order to provide our services, we need your personal data in the form of: name, surname, email address.
  3. The service user acknowledges that the provision of personal data by him/her marks the beginning of the Administrator's processing and is voluntary, however, the lack of consent for its processing may result in the Administrator's inability to provide electronic services to the user via the website.

§5

Duration of storage of personal data

Your personal data will be stored for:

  1. the duration of the services until their completion and, after completion of the services, in connection with obligations under generally applicable law (e.g. taxation) for a period of 5 years,
  2. necessary for the Administrator to assert or defend against claims in connection with its operations̨ on the basis of generally applicable law, taking into account the periods of limitation on claims set out in generally applicable law,
  3. if you have given your consent to the processing of your data for a particular purpose, until you withdraw your consent,
  4. for the purpose of accountability, i.e. to prove compliance with the provisions on the processing of personal data, they will be retained for as long as the Controller is obliged to retain the data or documents containing them for the purpose of documenting compliance with legal requirements and enabling control by public authorities.

§6

Cookies

  1. When you visit altkomakademia.pl for the first time, you are informed about the use of cookies. Cookies are computer data, in particular text files, which are sent by the website to your browser. The browser, in turn, sends them to the website when you visit it again, in order to maintain the continuity of a given session. They also allow specific data to be saved so that you do not have to re-enter them when you return from another website.
  2. By remaining on the Website, you accept the use of cookies, and failure to change, on your part, the settings of your browser, is tantamount to consent to the use of "cookies". At the same time, the installation of "cookies" is necessary for the proper provision of services on the Website.
  3. The user can change the settings of his/her browser regarding the handling and storage of cookies at any time.
  4. The Website uses two types of "cookies" - "session" and "permanent". Session" files are temporary files which remain on the user's device until they log off from the website or until the browser is switched off. Permanent" cookies remain on the user's device for the time specified in the parameters of the "cookies" or until they are manually deleted by the user. Cookies used by partners of the website operator, including in particular website users, are subject to their own privacy policies.

§7

User rights and obligations

  1. A user who has provided personal data to the Administrator has the right to:
  2. access to their data and receive a copy of their data,
  3. rectification (amendment) of your data,
  4. deletion of data (the so-called right to be forgotten),
  5. restrictions on the processing of personal data,
  6. portability of your data to another controller,
  7. to object to the processing of your data as well as to the processing for direct marketing purposes,
  8. withdraw consent where the Administrator will process the User's data on the basis of consent, at any time and in any way, without affecting the lawfulness of the processing carried out on the basis of consent before its withdrawal,
  9. lodge a complaint with the President of the Data Protection Authority if the User considers that the processing of personal data violates the provisions of the GDPR.

  1. As part of the exercise of the rights referred to in paragraph 1, the User may request the Administrator to perform certain actions. The request should be addressed via the e-mail box: iodo@altkom.pl.
  2. In the event that the User permanently deletes the personal data necessary for the Administrator to carry out the services provided through the website, the User will lose the possibility to use these services.

§8

Recipients of the data

  1. For the processing and handling of the payment process, your personal data will be made available to the payment operators, i.e: Elavon Financial Services
  2. At the time of payment, the payment operator, i.e. Elavon Financial Services Ltd, becomes the administrator of your data and the privacy policy of the operator then applies.
  3. The recipients of the personal data processed about you will be the providers and supporters of the Administrator's ICT systems.
  4. Insofar as this is justified by the purpose of the processing, we will also transfer personal data to entities that act on our behalf, in particular:
    1. providers of IT services and solutions,
    2. providers of accounting services,
    3. to providers of legal, financial, insurance and administrative services; and
    4. auditors
  5. For some of the training courses provided by the Administrator which are subject to external examinations and certification, it will be necessary for the trainee/learner to create an individual account and provide personal data to the external certification body in order to complete the training course and pass the examination.
  6. In the egasmination process defined in para. 5 above, the trainee/trainee entrusts the personal data necessary for the execution of the egasmination independently on the legal basis specified by the external entity.

§9

Final provisions

To the extent not covered by this privacy policy, the relevant provisions of Polish law shall apply.

The administrator reserves the right to make changes to the privacy policy as a result of changes in legislation.

The Administrator reserves the right to change the website's privacy policy, which may result from advances in internet technology, possible changes in data protection law and the development of the Website. We will inform users of any changes in a visible and understandable manner.

This Privacy Policy is effective as of 06.03.2023.
