Since maintaining the confidentiality of the information you provide is important to us, in this Privacy Policy we define the purpose and method of data processing and define our obligations regarding the data entrusted to us. This Privacy Policy defines the principles of processing and access to information on the website www.altkomakademia.pl on your devices, used to provide services provided electronically.

§1 Definitions

  1. “Controller” means a natural or legal person, public authority, agency or other body which alone or jointly with others determines the purposes and means of processing personal data; where the purposes and means of such processing are determined by Union law or the law of a Member State, the controller or the specific criteria for its determination may also be laid down in Union law or in the law of a Member State.
  2. “Personal data” means any information relating to an identified or identifiable natural person (“data subject”); an identifiable natural person is one who can be identified, directly or indirectly, in particular by reference to an identifier such as a name, an identification number, location data, an online identifier or to one or more factors specific to the physical, physiological, genetic, mental, economic, cultural or social identity of that natural person.
  3. “Processing” means an operation or set of operations performed on personal data or sets of personal data in an automated or non-automated manner, such as collecting, recording, organizing, structuring, storing, adapting or modifying, downloading, browsing, using, disclosing by transmission, disseminating or otherwise making available, matching or combining, limiting, deleting or destroying. 4. “Data recipient” means a natural or legal person, public authority, entity or other entity to whom personal data are disclosed, regardless of whether it is a third party.
  4. “Consent of the data subject” means the voluntary, specific, conscious and unambiguous demonstration of will by which the data subject, in the form of a declaration or a clear confirmatory action, consents to the processing of personal data concerning him/her.
  5. “Cookies” – means computer data, in particular small text files, saved and stored on devices through which the User uses the websites of the Service.
  6. “Service” – means the website under which the Administrator runs the website, operating in the domain www.altkomakademia.pl
  7. “Device” – means an electronic device through which the User gains access to the websites of the Service.
  8. “User” – means an entity for which, in accordance with the Regulations and legal regulations, services may be provided electronically or with whom an Agreement for the provision of services electronically may be concluded.
  9. “GDPR” – Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data and repealing Directive 95/46/EC (General Data Protection Regulation).

§3 Purpose and legal basis for processing personal data

Your personal data will be processed for the purpose of:

  1. implementing the service of providing training – in accordance with art. 6 sec. 1 letter b of the GDPR,
  2. marketing products and services – the basis for processing is art. 6 sec. 1 letter a “consent” of the GDPR,
  3. replying to an inquiry sent using the contact form on the basis of art. 6 sec. 1 letter b of the GDPR,
  4. considering complaints, claims and applications and, as part of these activities, providing answers on the basis of art. 6 sec. 1 letter b of the GDPR,
  5. possible determination, investigation, enforcement of claims or defense against claims, which are the implementation of the legitimate interest of the Administrator (such as debt collection, conducting court and enforcement proceedings) on the basis of art. 6 sec. 1 letters c and f of the GDPR,
  6. preventing abuse and fraud – in order to ensure security in the scope of the Services provided in accordance with art. 6 sec. 1 letter f of the GDPR,7. remembering your preferences and settings such as: login, password, IP address, login date and time – then the basis for processing will be Art. 6 sec. 1 letter f of the GDPR in connection with Art. 173 of the Telecommunications Law.

§4 Scope of collected personal data

  1. During the registration process and further use of the website www.altkomakademia.pl, we ask you to provide your personal data in order to provide services provided via our website.
  2. To provide services, we need your personal data in the form of: name, surname, email address.
  3. The user of the service acknowledges that providing personal data by him/her means the beginning of processing by the Administrator and is voluntary, however, the lack of consent to their processing may result in the inability of the Administrator to provide services to the User electronically via the website.

§5 Duration of storing personal data

The User’s personal data will be stored for:

  1. the duration of the provision of services until their provision is completed, and after the completion of the provision of services in connection with obligations arising from generally applicable legal provisions (e.g. tax) for a period of 5 years,
  2. necessary for the Administrator to pursue claims in connection with the conducted activity or defend against claims, based on generally applicable legal provisions, taking into account the limitation periods for claims specified in generally applicable legal provisions,
  3. in the event of consent to the processing of data for a given purpose – until the consent is withdrawn,4. for the purpose of accountability, i.e. to prove compliance with the provisions on the processing of personal data, they will be stored for the period in which the Administrator is obliged to retain the data or documents containing them to document the fulfillment of legal requirements and enable control by public authorities.

§6 Cookies

  1. When you first visit the website www.altkomakademia.pl, you receive information about the use of cookies. Cookies are computer data, especially text files, that are sent by the website to your browser. The browser, on the other hand, sends them to the website when you visit again, in order to maintain the continuity of a given session. They also allow for remembering specific data, which does not have to be entered again after returning from another website.
  2. By staying on the website, you accept the use of cookies, and failure to change your browser settings is tantamount to expressing your consent to the use of “cookies”. At the same time, the installation of “cookies” is necessary for the proper provision of services on the Website.
  3. The User may change the settings of their browser at any time, in terms of handling and saving cookies.4. Two types of “cookies” files are used within the Website – “session” and “persistent”. “Session” files are temporary files that remain on the user’s device until logging out of the website or closing the web browser. “Permanent” files remain on the user’s device for the time specified in the “cookie” file parameters or until they are manually deleted by the user. “Cookies” files used by the website operator’s partners, including in particular the website users, are subject to their own privacy policies.

§7 User’s rights and obligations

  1. A User who has provided the Administrator with their personal data has the right to:
    • access their data and receive a copy thereof,
    • correct (amend) their data,
    • delete their data (the so-called right to be forgotten),
    • limit the processing of personal data,
    • transfer their data to another administrator,
    • object to the processing of data, as well as processing for the purposes of direct marketing,
    • withdraw consent in the event that the Administrator processes the User’s data based on consent, at any time and in any manner, without affecting the lawfulness of the processing carried out on the basis of consent before its withdrawal,
    • file a complaint to the President of the Personal Data Protection Office, if the User considers that the processing of personal data violates the provisions of the GDPR.10. A complaint may be filed with: the President of the Personal Data Protection Office, ul. Stawki 2, 00-193 Warsaw.
  2. As part of the implementation of the rights referred to in sec. 1, the User may request the Administrator to perform specific actions. The request should be sent via e-mail: iodo@altkom.pl.2. In the event of permanent deletion by the User of personal data necessary for the Administrator to perform services provided via the website, the User will lose the ability to use these services.

§8 Recipients of data

  1. In order to implement and service the payment process, your personal data will be made available to payment operators, i.e.: Elavon Financial Services sp z o.o.
  2. At the time of payment, the Controller of your data becomes the payment operator, i.e. Elavon Financial Services sp z o.o. and the Privacy Policy of the operator applies.
  3. The recipients of your processed personal data will be entities providing and supporting the Administrator’s IT systems.
  4. To the extent justified by the purpose of processing, we will also transfer personal data to entities that act on our behalf, in particular:
    • providers of IT services and solutions,
    • entities providing accounting services,
    • entities providing legal, financial, insurance and administrative services and
    • auditors.
  5. In the case of some training courses conducted by the Administrator that are subject to external examinations and certification, it will be necessary for the trainee/student to set up an individual account and provide personal data in an external certification body in order to complete the training and pass the exam.
  6. In the examination process specified in point 5 above, the trainee/student entrusts the personal data necessary to conduct the examination independently on the legal basis specified by the external entity.

§9 Final provisions

To the extent not covered by this privacy policy, the relevant provisions of Polish law shall apply. The Administrator reserves the right to introduce changes to the privacy policy resulting from changes in legal regulations.

The Administrator reserves the right to change the privacy policy of the website, which may result from the progress of Internet technology, possible changes in the law on personal data protection and the development of the Service. We will inform users about any changes in a visible and understandable manner. This Privacy Policy is effective from 06.03.2023.
